Terms of Service

These terms are an agreement between you and BY ARTISAN LLC, the company that makes Pupik. They cover our website at pupik.app, the Pupik app at play.pupik.app, the Pupik apps for phones and tablets, and everything in them. Together we call these "the Service." When we say "we," "us" or "our," we mean BY ARTISAN LLC. When we say "you," we mean the grown-up who uses the Service or holds the account. Please read them carefully, together with our Privacy Policy, which explains how we handle your information.

1. Who we are

Pupik is made by BY ARTISAN LLC, a Wyoming limited liability company, at 312 W. 2nd St #2383, Casper, WY 82601, United States. You can reach us any time at hello@pupik.app.

2. Agreeing to these terms

By creating an account, starting a free trial, subscribing or using the Service, you agree to these terms. If you don't agree, please don't use the Service.

Pupik is for children, but the account is for grown-ups. You must be at least 18 years old (or the age of majority where you live, if that's older) to create an account, start a trial or subscribe. You're responsible for your account and for how the children in your household use Pupik. Pupik is designed for children ages 2 to 8 to enjoy with a grown-up nearby, and decisions about screen time, and about which activities suit your child, are yours to make.

3. The Service

Pupik is a calm, low-stimulation digital playroom rooted in Jewish life. It offers open-ended activities with no scores, no levels, no timers and no ads, along with an area for grown-ups that includes settings, ideas for play and printable activity sheets.

Pupik keeps growing. We add, change, improve and sometimes retire activities and features, including seasonal ones. We don't promise that any particular activity or feature will always be available.

Pupik is made for play. It is not a course, and we don't promise any particular educational or developmental result.

4. Your account

• You sign in with a one-time link we email to you (or, where offered, with Sign in with Apple or Google). Please keep access to that email account secure, because anyone who can open your email can sign in to Pupik.
• Give us an email address that is yours and that you check, so you can receive sign-in links and important messages.
• An account and its subscription are for one household. Please don't share your sign-in with people outside it.
• Tell us right away at hello@pupik.app if you think someone has used your account without permission.
• You can delete your account at any time in the grown-ups area of the app. Deleting it cancels a subscription bought on our website. A subscription bought in the App Store or Google Play must be cancelled in your Apple or Google account settings.

5. Subscriptions and billing

Plans and prices

Pupik is offered as a household subscription: $7.99 a month or $59 a year (US dollars). The price, the billing period and any taxes that apply are shown before you confirm your purchase.

Free trial

New households can try Pupik free for 14 days. On the website, you enter a payment card when you start the trial. When the trial ends, it automatically becomes a paid subscription and your card is charged for the plan you chose, unless you cancel before the trial ends. If you cancel during the trial, you won't be charged.

There is one free trial per household and per payment card. We may decline a trial that doesn't meet this rule. Trials started in the App Store or Google Play follow Apple's or Google's own trial rules.

Automatic renewal

Your subscription renews automatically at the end of each billing period (each month or each year) until you cancel. By subscribing, you authorize us (through Stripe) to charge the payment method on file for each renewal at the price that applies at that time, plus any taxes. If a payment doesn't go through, we or Stripe may try again, and access may pause until the payment is updated.

Cancelling

You can cancel at any time. For a subscription bought on our website, open the grown-ups area of the app and go to your subscription, which takes you to Stripe's secure page for managing it. Cancelling stops future renewals. You keep access until the end of the period you've already paid for, and you won't be charged again after that.

A subscription bought in the App Store or Google Play must be cancelled in your Apple or Google account settings (see section 7).

Changing plans

• Monthly to yearly: the change happens right away. You're charged for the yearly plan at once, minus a prorated credit for the unused part of your current month.
• Yearly to monthly: the change takes effect at the end of the year you've paid for. You keep your yearly plan until then.

Price changes

We may change our prices from time to time. If a price change affects your subscription, we'll tell you in advance, before it applies to your next renewal, so you have time to cancel if you wish. A new price never applies to a period you've already paid for.

6. Refunds

For subscriptions bought on our website, you can ask for a full refund within 30 days of any charge. Just email hello@pupik.app from the email address on your account and tell us which charge you'd like refunded.

When we refund a charge in full, your subscription ends and access ends right away.

Purchases made in the App Store or Google Play are refunded by Apple or Google under their own refund policies. We can't issue refunds for them ourselves.

Nothing in these terms takes away any right to a refund or cancellation that you have under the law where you live.

7. If you subscribe through the App Store or Google Play

If you subscribe through the Apple App Store or Google Play, Apple or Google bills you and manages your subscription, including renewals, cancellations, trials and refunds, under their own terms. You can manage or cancel it in your Apple or Google account settings. Deleting the app or your Pupik account doesn't cancel it.

If you downloaded Pupik from the App Store

• These terms are between you and BY ARTISAN LLC, not Apple. We, not Apple, are responsible for the app and its content.
• Your license to use the app is limited to Apple-branded devices you own or control, as allowed by the Usage Rules in Apple's Media Services Terms and Conditions. Members of your Family Sharing group may also use it where Apple allows.
• Apple has no obligation to provide any maintenance or support for the app. Please contact us for help.
• If the app fails to meet any warranty that applies by law, you may notify Apple, and Apple may refund the purchase price you paid for it. To the fullest extent the law allows, Apple has no other warranty obligation for the app.
• We, not Apple, are responsible for handling any claims about the app, including product liability claims, claims that the app doesn't meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
• If anyone claims that the app or your use of it infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and resolving that claim.
• You confirm that you are not located in a country subject to a US government embargo or designated as a "terrorist supporting" country, and that you are not on any US government list of prohibited or restricted parties.
• You must also follow any third-party terms that apply when you use the app, such as the terms of your mobile carrier.
• Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple has the right to enforce them against you as a third-party beneficiary.

If you downloaded Pupik from Google Play

Google Play's terms and policies apply to your purchase. Google is not responsible for the app or its content, and support for the app comes from us.

8. Using Pupik fairly

Pupik is for personal, household use. Please don't:

• copy, sell, rent, share publicly or otherwise distribute Pupik or its content, except as these terms allow;
• use Pupik in a school, classroom, daycare or other organization, or for any business purpose, without a separate agreement with us (we'd be glad to talk: email hello@pupik.app);
• get around the subscription, the free trial rules or any security feature;
• copy, change, decompile or reverse-engineer the app's code, except where the law allows it;
• use bots, scrapers or other automated tools to access the Service or collect its content;
• disrupt the Service or try to access accounts, systems or data that aren't yours;
• use the Service in a way that breaks the law or harms others.

9. Our content and your license

All of Pupik's artwork, characters, illustrations, animations, sounds, music, text, activities and software, and the Pupik name and logo, belong to BY ARTISAN LLC or to those who license them to us. They are protected by copyright, trademark and other laws.

While you have an active subscription or free trial, we give you a limited, personal, non-exclusive, non-transferable license to use the Service for your own household's non-commercial enjoyment, under these terms. Everything not expressly granted to you here is reserved by us.

10. Printables

The grown-ups area includes printable activity sheets. You may download and print them, as many copies as your household needs, for personal, home use. Please don't sell them, share them outside your household, post them online, or use them in a classroom or business without our written permission.

11. Your ideas and feedback

We love hearing from families. If you send us ideas, suggestions or feedback, you're free to do so, and we're free to use them to improve Pupik without paying you or owing you anything. Please don't send us anything you want to keep confidential.

12. Availability and changes

We work hard to keep Pupik running smoothly, but we can't promise it will always be available, uninterrupted or free of errors. It may be unavailable at times for maintenance, updates or reasons outside our control. Some features may need a recent device, operating system or browser, or an internet connection.

We may change, suspend or stop any part of the Service. If we ever stop offering Pupik altogether, we'll tell you in advance, and we won't charge you for any renewal after it ends.

13. Disclaimers

We care a great deal about making Pupik gentle and safe, but we provide it "as is" and "as available." To the extent the law allows, we make no promises beyond those written in these terms, including implied promises that the Service will be fit for a particular purpose, of a certain quality, or free of errors.

Pupik doesn't replace a grown-up's care and attention. Please supervise young children while they use a device, and use your judgment about what is right for your child.

Some places don't allow these kinds of disclaimers. If you live in one of them, some of this section may not apply to you.

14. Limits on our liability

To the extent the law allows:

• we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the Service;
• our total liability for any claim about the Service is limited to the greater of the amount you paid us for Pupik in the 12 months before the claim, or US $50.

Nothing in these terms limits liability that can't be limited by law, such as liability for fraud, gross negligence, willful misconduct, or death or personal injury caused by negligence, and nothing affects the rights you have as a consumer that can't be waived by contract.

15. Ending this agreement

You can stop using Pupik at any time. To end your subscription, cancel it as described in Cancelling. You can also delete your account in the grown-ups area.

We may suspend or close your account if you seriously or repeatedly break these terms, if we need to in order to protect the Service or other people, or if the law requires it. Where it's reasonable, we'll tell you first and give you a chance to fix the problem.

Sections of these terms that by their nature should continue after the agreement ends (such as those on our content, disclaimers, limits on liability and disputes) will continue to apply.

16. Governing law and disputes

These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules.

If something goes wrong, please email us first at hello@pupik.app. Most problems can be solved quickly and kindly that way, and we'll do our best to help. If we can't resolve it within 30 days, either of us may take the dispute to the state or federal courts located in Wyoming, and both of us agree to those courts' jurisdiction. Either of us may also bring a claim in small claims court where it qualifies.

If you live in the European Union or the United Kingdom, you also keep the protection of the mandatory consumer laws of the country where you live, and you may bring a claim in its courts.

17. Changes to these terms

We may update these terms from time to time. When we do, we'll post the new version here and change the date at the top. If a change is significant, we'll tell you by email or in the app before it takes effect. If you keep using Pupik after the change takes effect, you accept the new terms. If you don't agree, you can cancel your subscription and stop using the Service.

18. The fine print

• These terms and our Privacy Policy are the whole agreement between you and us about the Service.
• If any part of these terms can't be enforced, the rest still applies.
• If we don't enforce a part of these terms right away, we haven't given up our right to enforce it later.
• You may not transfer your account or these terms to anyone else. We may transfer them as part of a merger, sale or transfer of our business, and your rights under these terms will continue.
• We're not responsible for delays or failures caused by events beyond our reasonable control.
